AGREEMENT BETWEEN ALTERNATIVE BOOKSHOP ONLINE
AND (Name of Supplier Organisation)
..
(hereafter
referred to as the Supplier) submits to Alternative Bookshop
Online (hereafter referred to as ABO) the following details
of publications for inclusion in the ABO Catalogue: Title,
Author(s), Publisher's Name, ISBN, Recommended Retail Price,
Number of Pages, Format (see below), Description of Contents
(not exceeding 60 words).
Publications submitted must
conform to ABO Policy Guidelines as set out in Appendix
1 to this Agreement. ABO reserves the right not to offer
for sale or withdraw publications which contravene these
Policy Guidelines.
The Supplier
must have distribution rights for the publications submitted
and is responsible for any liabilities arising out of breach
of copyright.
Publications
are offered for sale at the Supplier's Recommended Retail
Price.
ABO reserves the right to access
similar or identical publications from other suppliers.
The Supplier accepts that purchasers
of publications are customers of ABO. ABO issues Invoices
to customers.
Orders for publications are sent to the
Supplier by e-mail. The Supplier confirms receipt of and
despatch of orders by e-mail to ABO. The Supplier notifies
ABO if the order cannot be met. ABO sends receipts to the
Supplier for orders despatched to customers.
All publications supplied are in new condition
and are the latest edition available.
The Supplier adequately packages
orders and despatches them to customers together with a
Delivery Note. The Supplier is responsible for the cost
of any orders that do not reach customers.
Orders
should normally reach customers not more than fourteen
days after the Supplier has received the order but,
in accordance with UK distance selling regulations, must
reach customers in the European Union area within twenty-eight
days of the order being received by the Supplier.
Customers
have the right to cancel an order within seven days of it
being placed. If an order already has been despatched to
a customer before notice of cancellation has been received
by ABO then the customer is responsible for the cost of
returning the order to the Supplier. Returned publications
must be in new condition for ABO to refund the customer's
payment. The Supplier must notify ABO upon receipt of the
returned order and whether or not the publications are in
new condition.
The Supplier
receives seventy per cent of the recommended
retail price of their publications sent to customers plus
postage costs as follows:

Customers are not charged and
suppliers are not paid postage costs in the case of periodicals.
For the purposes of this agreement
a pamphlet format is a publication weighing
up to eighty grams and a book format is a
publication weighing more than eighty grams.
Payments
to the Supplier will be on a monthly basis with payment
for the previous month's orders being made by the end of
the current month. Payments will normally be made by BACS
electronic transfer.
It is
the supplier's responsibility to give the correct bank information
for purposes of BACS credits. ABO do not accept responsibility
for monies credited to the wrong bank account by third parties.
The term
of this agreement begins when the Supplier receives notice
of acceptance from ABO. Thirty days notice must be given
by ABO or the Supplier in order to terminate this contractual
agreement.
The Supplier
may not assign this agreement without the permission of
ABO.
The Supplier will be notified
of any changes that ABO may wish to make to these terms
and conditions. If the Supplier does not accept any such
changes then this agreement with ABO ends thirty days after
notification of the proposed changes.
Appendix
1
POLICY
GUIDELINES ON PUBLICATIONS DISTRIBUTED
The publications accepted for
distribution must display a general respect for human freedom
and dignity.
In particular, Alternative
Bookshop Online will not distribute publications that have
any racist, sexist, pornographic (as opposed to erotic)
or fascist content.
ABO reserves
the right not to offer for sale or withdraw publications
which contravene these guidelines.
